TRANSFER PROCESS

SOMETIMES THINGS CAN AND DO GO WRONG

Here's when to expect a delay:
  • Existing title and or bond deeds of the seller's property are already lost when we start with the transfer process: 3 – 4 weeks
  • Seller has never paid rates & taxes on the property, no valuation loaded on the property or has been incorrectly billed: 3 – 6 months. Rather involve us now so that we can start the process in advance with the council to save time
  • Seller's or Purchaser's tax affairs are not in order (outstanding tax or VAT payments or outstanding tax or VAT returns): SARS will not issue a Transfer Duty Receipt until arrangement for down payment or payment in full has been made for the outstanding amount. Rather tell us now in advance so that we can make the necessary arrangements with SARS on your behalf
  • Seller has fallen behind on bond instalments, and bond handed over to the legal department of the relevant bank: 3 – 4 weeks
  • Interdict noted against the seller's property: outstanding debt has to be settled or guaranteed first and then sheriff will instruct Deeds Office to uplift the interdict: 3 – 4 weeks
  • The property is being subdivided: 2 – 6 months – will advise accordingly
  • The property is in a deceased estate: 4 – 6 months
  • The deed of sale is subject to the sale of the purchaser's existing property: the transfer process effectively only starts when the purchaser's property is sold and the second purchaser's bond is granted
